These Terms of Service ("Terms") govern your access to and use of the TrainCheckSpot fitness coaching platform (the "Service"), operated by [LEGAL ENTITY NAME] ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms work together with our Privacy Policy, which explains how we handle your data.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a coach account. By using the Service you represent that you meet this requirement and that the information you provide is accurate and kept up to date.
The Service has two types of users: coaches, who register accounts and manage clients, and clients, who access their assigned programs through a private link provided by their coach. Coaches are responsible for the clients they add and for having the right to enter those clients' information.
The Service is a tool for organizing and delivering fitness programs. It does not provide medical advice, diagnosis, or treatment. Content created or delivered through the Service — including workouts, prescriptions, and progress data — is not a substitute for professional medical or healthcare guidance.
Clients should consult a qualified healthcare professional before beginning any exercise program. Coaches are solely responsible for the appropriateness and safety of the programs they create and assign. You use the Service and act on its content at your own risk.
You agree not to:
You retain ownership of the content you submit (such as client information, programs, exercises, and logged data). You grant us a limited license to host, process, and display that content solely to operate and provide the Service to you.
You are responsible for the accuracy and legality of the content you submit, including obtaining any consents required to store client personal and health information.
[If/when paid plans are offered, describe pricing, billing cycle, renewals, refunds, and cancellation here. During the beta the Service may be offered free of charge, and features, limits, and pricing may change.]
The Service is currently offered as a beta. It is provided "as is" and may contain bugs, change without notice, or be interrupted. We may add, modify, or remove features, and we do not guarantee uninterrupted or error-free operation during the beta period.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to other users or the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (such as disclaimers and limitations of liability) will survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the [12] months before the claim or [AMOUNT, e.g. $100].
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in [VENUE].
